Driver Partners Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Smart24x7 Response Services Pvt. Ltd. (“we”, “us”, or “our”) via our online platform and mobile application (collectively, the “Platform”). By registering as a driver on our Platform, you agree to be bound by these Terms. Please read them carefully before using our services.
1. Registration and Account Security
1.1 Eligibility: By registering on our Platform, you represent that you are legally eligible to work as a driver and possess all necessary licenses, permits, and certifications required by local laws and regulations.
1.2 Account Information: You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
1.3 Account Verification: We may require additional information or documentation to verify your identity and eligibility to use our Platform. We reserve the right to approve or reject your registration at our discretion.
2. Platform Usage
2.1 Service Provision: Our Platform facilitates connections between drivers and clients or fleet operators who require logistics services. We do not provide logistics services directly and are not responsible for the actions or decisions of the clients or fleet operators.
2.2 No Guarantee of Job Assignments: Registration on our Platform does not guarantee that you will receive any job assignments. Job opportunities are provided at the sole discretion of clients or fleet operators who use the Platform. We do not have any control over the availability, selection, or assignment of jobs.
2.3 Compliance with Client Requirements: When accepting a job assignment, you agree to comply with all requirements and conditions set by the client or fleet operator, including but not limited to pickup and delivery times, cargo handling, and communication protocols.
2.4 Use of the Mobile App: You are required to use our mobile app to accept job assignments, track deliveries, and communicate with clients. You must ensure that your mobile device is compatible with our app and that it is functioning properly at all times.
3. Driver Responsibilities
3.1 Professional Conduct: You agree to perform all job assignments in a professional and timely manner. You must adhere to all applicable laws and regulations, including traffic laws, and ensure that your vehicle is maintained in a safe and roadworthy condition.
3.2 Safety and Security: You are responsible for the safety and security of the cargo entrusted to you. You must follow all safety protocols provided by the client or fleet operator and report any issues or incidents immediately.
3.3 Communication: You agree to maintain open and timely communication with clients, fleet operators, and our support team. You must respond promptly to job assignments, updates, and inquiries.
3.4 Confidentiality: You agree to keep confidential any information you receive through the Platform, including but not limited to client details, job assignments, and cargo information. You must not share this information with any third party unless required by law.
3.5 Compliance with Laws and Regulations:
a. Legal Compliance: You are required to comply with all applicable local, state, and federal laws and regulations, including those related to driving, vehicle maintenance, and cargo transportation. This includes but is not limited to traffic laws, vehicle safety standards, and environmental regulations.
b. Company Compliance: In addition to complying with legal requirements, you agree to adhere to any specific compliance policies, procedures, or standards imposed by the companies or fleet operators you work for. This includes, but is not limited to, compliance with their safety protocols, operational guidelines, and any other specific requirements related to the handling of goods and communication practices.
c. Documentation and Reporting: You must maintain and carry all required documentation, such as driver’s licenses, permits, and vehicle inspection reports, and provide these documents to clients or authorities upon request. You are also responsible for reporting any legal or regulatory violations to the appropriate authorities and our support team.
4. Fees and Payments
4.1 Service Fees: We may charge a service fee for the use of our Platform, which will be deducted from your earnings or invoiced separately. The fee structure will be communicated to you during registration and is subject to change with prior notice.
4.2 Payments: Payment for job assignments will be made directly by the client or fleet operator according to their payment terms. We are not responsible for any delays, disputes, or issues related to payment.
4.3 Taxes: You are responsible for determining and paying any taxes applicable to your earnings from job assignments. We do not provide tax advice, and you should consult a tax professional for guidance.
5. Termination and Suspension
5.1 Termination by You: You may terminate your account at any time by providing us with written notice. Upon termination, you will no longer have access to the Platform or any job assignments.
5.2 Termination or Suspension by Us: We reserve the right to suspend or terminate your account at any time, with or without cause, including but not limited to violations of these Terms, fraudulent activity, or misconduct.
5.3 Effect of Termination: Upon termination of your account, any pending job assignments will be canceled, and you will not be entitled to any further payments from those assignments. We may retain your account information for record-keeping purposes as required by law.
6. Limitation of Liability
6.1 Platform Availability: We strive to maintain the availability and functionality of our Platform but do not guarantee uninterrupted access. We are not liable for any losses or damages resulting from Platform downtime, technical issues, or errors.
6.2 Third-Party Actions: We are not responsible for the actions or decisions of clients, fleet operators, or any third parties using our Platform. You agree that we are not liable for any job assignments, payments, or disputes arising from your interactions with third parties.
6.3 Indemnification: You agree to indemnify, defend, and hold harmless [Your Company Name], its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Platform or your breach of these Terms.
7. Governing Law and Dispute Resolution
7.1 Governing Law: These Terms are governed by and construed in accordance with the laws of New Delhi India, without regard to its conflict of laws principles.
7.2 Dispute Resolution: Any disputes arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of Corporate guidelines. The arbitration shall take place in Gurugram, Haryana, and the language of the arbitration shall be english.
8. Modifications to Terms
We reserve the right to modify these Terms at any time. Any changes will be effective upon posting the revised Terms on our Platform. We will notify you of significant changes, and your continued use of the Platform after the changes become effective constitutes your acceptance of the revised Terms.
